As-Is Sales Subject To The Probate Code

As-is subject to the probate code is what many buyers agents forget when they write offers. We always put this into the agent confidential remarks on MLS. A seller is under no obligation to repair anything on the California residential purchase agreement. Probate sales double-down, if you will, on the as-is.

Getting into contract on a probate sale and then attempting renegotiating the price later is not a smart idea. Probates generally are working with little to no extra cash and every penny is most often required by the administrator of the estate.

If you are trying to purchase a probate listing, always make your highest and best offer and stick to it. Your inspections are to satisfy you as to what you are buying. As-is subject to the probate code is always an important consideration when writing an offer.

Unauthorized Entry into A Home for Sale

Unauthorized entry into a home for sale was a message I received yesterday from an agent at another company. He had reported the incident to the Department of Real Estate but they said this was not something they governed.

The listing had MLS instructions to call for an appointment. There was a Metrolist lockbox on the property. The MLS instructions contain the parameters of how agents can enter. To enter any other way is an ethics violation and this agent can be subject to a complaint filed at our local Sacramento Associations of Realtors board. This was the instruction I gave the complainant.

Seller’s showing instructions are posted on the MLS. There is also agent confidential comments posted that agents often fail to read. These comments are not viewable to the public.

This buyer’s agent allegedly entered the property without permission, did not call to make an appointment and just went in, holy smoke, a big no-no. When in doubt, remember, the showing instructions are there for a reason.

How Much Time Should A Realtor Spend Meeting with Clients?

How much time should a Realtor spend meeting with clients? It depends. At the first meeting, I spend as much time as they need. That can be an hour to 4 or 5 hours on the first meeting. Time spent is based on the clients’ need to feel comfortable and confident in the person they are hiring. Sometimes clients need to spend more time getting to know their Realtor, especially at the first meeting.

I met the nicest people this weekend who had previously worked with our team. This was the first time we met. Together, we walked their piece of rural real estate. It was such an interesting piece of property. There were many beautiful oak trees. This amazing pomegranate tree was just covered with fruit. We picked some fruit together and sat in the shade looking onto the property. There were so many wild turkeys about, too. What a glorious afternoon.

The clients were very warm and interesting people. I loved hearing about their life. She had very soulful eyes and beautiful long platinum hair. A very interesting conversationalist and an intelligent woman. We both share a love for animals. Her husband is a very nice man and you could see how much he cared for her. The time passed so quickly, four hours went by, and it seemed like time had stood still. My phone kept dinging with messages, but these people were my focus. I returned my calls after.

What I love most about my job is making that genuine connection with people. It is so important for clients to know they matter. Of course, we get paid our business — we are not a non-profit, but getting paid doesn’t mean we don’t care. Quite the opposite; we want every client to feel so important and when we close escrow, they are happy to pay us and feel they received premiere personalized service. That’s how you get 5-star reviews.

I’m so excited to work with this couple. I adore their acreage and will do a top-shelf job for them. How much time should a Realtor spend meeting with clients? As much time as is needed. When I walk out the door, they are satisfied that the time needed to market the property will be invested.

Repair requests between Sacramento Realtors are how the process starts. A buyer’s agent starts the inspection reports for the buyer. Then the reports are reviewed by the buyer and the buyer’s agent. They create what I call a hit list but it is formally called a request for repairs. This request can be as little as smoke detectors to be installed to asking the seller to fix everything in the home inspection request.

The request is sent to the Seller’s agent. It is then reviewed by the seller. The seller is under no obligation to repair anything. In a seller’s market, a buyer would be wise to ask for very little.
