Title Held In Trusts And Divorce

Dealing with title held in trusts and divorce is an interesting topic. When people get married, they often create a trust together. In general, they are each named as a trustee. When they buy a home, the title is often put into a trust. Unfortunately, in some cases, divorce happens. On this topic, I received a phone call from a referral source. He said he had met someone divorcing and they needed to sell their home.

Signing documents online is generally simple enough. This may not be possible in a divorce, especially if they are still living together in the property. When the clients can not agree, and I am in the room or on a conference call, sometimes I excuse myself. During the details of trusts and divorce when signing a listing agreement, with communications between the parties strained, I always say call your attorneys for legal advice.

When escrow closing happens, the sellers usually have the proceeds wired to their bank. One couple got creative and opened two separate bank accounts with each being named as a trustee signer, in the name of the trust. The title officer said, no, she could not split the funds into two different accounts. Her reason was the official trust documents named both co-trustees, so they had to have one account in the name of the trust. Both trustees had to be on the trust checking account, jointly. The trustees went back to the bank and opened another trust account.

What I love about real estate are unique situations that occur and working through them. Title held in trusts and divorce is a topic of much discussion. I recently attended the Placer County Association with fiduciaries attorneys and trust planners. The topic was trusts and divorce. Always trustees and successor trustees should consult with their attorney for any legal advice.

Will discount internet real estate brokerages replace local Realtor experts? We recently took a listing as a seller found us online. She had previously been on the market three months. Poor seller made the mistake of hiring a discount internet Realtor.

She said they told her to buy a vendor combination key box, and she made flyers and showed the property. The property sat for these months while the seller made three house payments, paid HOA fees, utilities and maintenance costs. These ongoing expenses were triple the amount she potentially would have saved. If a property doesn’t sell with a discount brokerage, it doesn’t mean much. Happens a lot.

We took the listing, immediately staged the home and started our complete marketing plan. Our open houses generated several opportunities and we put the house in escrow within 30 days with a fabulous offer. The seller was thrilled and so appreciative. The best money she spent was . . . wait for it, hiring a quality local area real estate team!

Will discount internet real estate brokerages replace a local Realtor expert? Not likely. Self help real estate does not work. We were thrilled to sell this property for the seller.

Market cycles in Sacramento real estate can be confusing to new buyers entering the Sacramento market. Homes fly off the shelves in some areas, and other areas may take a while. Take the condos in Alicante Villas for instance. The days on market for past closed sales in this complex are higher than the days on market for single family residences in the area.

What can buyers do to increase odds in their favor? Buyers need only do one thing, just conform to the market cycles. When your agent completes a market analysis on sales in an area you want to live, if homes are selling over list, offer over list. Buyers, whatever the trends, strike quick and aim to win every time you sign an offer.

What often happens is, although many of us have over 20 years of experience, our clients do not always listen to us. A favorite saying of mine: I’m just the expert but you are the boss.

September 11th Is A Day Of Remembering

September 11th is a day of remembering

September 11th is a day of remembering for many people. There are certain days in your memory where you know where you were standing and what you were doing. It was a day I will forever remember. Also, it was my Sister’s birthday. This is a hard holiday for her as she doesn’t feel like celebrating on September 11th. We celebrate her birthday a few days after.

It is a day each year where I tend to work a bit harder. It was a busy day in real estate and so much going on. The year is almost 2/3 of the way over and we are quickly approaching the year 2020. So, September 11th is a day of remembering. It was also a challenging day in Sacramento real estate .There were escrows closing and new listings to work on. The day quickly came to a close. There is always more to do each new day.
