The Comparison Between Sacramento Real Estate and Pastries

Sacramento real estate is bit like pastries.

Selling Sacramento real estate is a little bit like selling pastries. Everybody always wants the cherry beignet or creme brûlée, and they walk right on by the original glazed creme doughnuts or cinnamon rolls. Sell out of the chocolate-sprinkled pastries, and people go wild and keep calling, wanting to know when you’ll get more chocolate sprinkles. Or, maybe it bothers me more than I let on that Doughbot has closed its doors over on 10th Street and W.

The thing is once a home goes into escrow, it seems everybody wants it even if for months nobody wanted it before. Bam, pending sale and buyer’s agents start calling to see if the seller won’t at least allow one more showing, puhlease. They want to know how the sale is moving. If we don’t have a release of contingencies on file, we don’t really know for certain how the sale is moving.

The truth is I can’t predict whether a buyer will close escrow on a Sacramento real estate transaction. I can call the loan officer to ask if the buyers have actually filled out a loan application and submitted tax returns, and that’s a step in the right direction, but it doesn’t assure anybody that the buyer will close. Buyers have a way of freaking out lately, maybe more so than usual. Sacramento real estate has been a bit squirrelly over the summer.

It’s almost like I want to ask the buyer’s agent, are you certain your buyer wants to buy a home in Sacramento? Because a signed purchase offer for that piece of Sacramento real estate is NOT that assurance. It should be, but it’s not. Further, I would like to shelter my seller from any disappointment these types of situations can generate. But we can’t protect them from buyers who will change their minds.

Their agents aren’t likely to ask if they are certain. Their agents are more likely to say sign here and here,?and thanks for the earnest money check. Not because they’re ruthless or whatever, it’s because they often wrongly assume that because a buyer signs a purchase offer that the buyer really wants to buy the house. So, I don’t know how solid an offer is and there is no way I can accurately or honestly tell a buyer’s agent if it’s worth pursuing a pending sale.

If the buyer doesn’t want the chocolate eclair but prefers the creme brûlée, then by all means, put a backup offer on the creme brûlée but that chocolate eclair, I tell you, is mighty tasty. I encourage you to call Elizabeth Weintraub for all of your Sacramento real estate needs.

How to Profit from a 50% Pending Home Sales Fallout in Sacramento

Cancel-Contract-250x177It pays today to be a home buyer on a backup offer in Sacramento since we seem to be experiencing such a high cancellation rate on escrows; in some cases up to 50% of the pending sales are falling out. I say this not to be an alarmist but to point out what other real estate experts are too frightened to bring up because they are worried this kind of data would harm our fragile sales market. Every real estate professional, just about, knows this is happening in the Sacramento real estate market, if they’re doing any kind of business. They’re just not talking about it.

That’s because we have to be positive and spread only good news about Sacramento real estate. Oh, spittooey. You’ll read in other news media that sales are UP. What media is not telling you is real estate sales naturally increase in the spring. Inventory is low, which is true, inventory is low as compared to previous years, but it doesn’t matter because there aren’t enough buyers for it. Home buyers today typically lust over only the best home on the block and the rest are ignored.

On top of this, buyer’s agents think they are working with buyers because buyers tell the agents they are buyers. They might even pop up with a pre-approval letter in possession. But it doesn’t mean they are a buyer, because a buyer closes escrow and eventually ends up with a home.

It’s not the end of the world if an escrow cancels, because it will generally turnaround and go back into escrow again under a second purchase contract within a relatively short period of time, but that’s why you want to be a backup buyer, if you can. Don’t think you can’t write a contingent offer, either, if you have a home to sell, because sellers are accepting contingent to sell offers from buyers.

For other listing agents, my advice is don’t put that listing into pending status until the buyer has deposited funds into escrow, which should occur within the 3 days MLS gives us to change the listing status. Because nobody wants to deal with the unfair stigmatization of a back-on-market listing because some doofus buyer on a whim canceled the escrow.

For buyer’s agents, don’t write multiple offers when your buyer can’t afford to buy each of those homes. Not only is your reputation as a Sacramento real estate agent at stake, but those types of “buyers” can easily morph into a vanishing act after both offers are accepted. If your buyers really want a pending home, consider writing a backup offer.

For buyers, get over the fact that homes might cost $100,000 more today than they did 3 years ago. Those days are gone. But prices are still low as compared to the prices pre-market crash. Don’t wait for interest rates to go up and slowly rising prices to price you out of the Sacramento real estate market all together. Get in while the getting is good, and for heaven’s sakes, stay there.

How to Keep a Home on the Market in Sacramento After Offer Acceptance

Home-for-sale-sacramentoI am finding that overall, many buyers are not very committed in our Sacramento real estate market. That’s a good reason to keep the home on the market after going into contract. Part of the reluctance to commit, I’m supposing, comes from the fact they feel pressured with multiple offers happening on such a large number of homes, and it’s frustrating that they have very few homes from which to choose. This is a scary market for first-time home buyers. We’ve never had a market like this in my lifetime before in Sacramento.

We have low prices but they are moving upwards quickly in some neighborhoods. Interest rates are historically low, around 3.75%, which is just incredible. A buyer’s purchasing power is immense. They can buy twice the home for half the money today, as compared to 7 years ago. But they have also witnessed first-hand the crash of the real estate market, and some of them feel very uncomfortable navigating in unchartered waters. It’s not unusual to go into escrow one day and then have the buyer cancel the next. This is why you want to keep the home on the market if at all possible without immediately jumping into pending status.

Home sellers in Land Park had this happen to them a while back. They negotiated in good faith an agreed-upon sales price and were relieved and thrilled that their home was sold. But, the following day, the buyers bailed. They didn’t give a good reason. See, that’s the thing, in California, a buyer can pretty much cancel a contract for any reason within the inspection period which, by default, is 17 days.

The next time we received an offer, the sellers were more cautious. The buyers wrote a clean offer, but until they removed the contingencies, the buyers could easily cancel. Their agent wrote an addendum containing verbiage about cancellation that was already preprinted in the purchase contract, and that’s part of what made the sellers worry. Agents don’t always think about how their addendums will be perceived by the sellers when they are trying to appease the buyers. But if the buyers require reassurance about cancellation rights, this makes the sellers understandably nervous. So, the purpose of the addendum backfired.

How to fix it was my quandary. Part of the solution was to keep the home on the market in active status. Once a seller takes a home off the market and then puts it back on the market, buyers begin to wonder what is wrong with the home. Why didn’t the buyers want to buy it? Did they uncover something horrible about the home? Is there a structural defect? When the truth is half the time “back on market” status is just due to flakey buyers: you’ve got the blind leading the blind. It’s much better to keep the home on the market for a while.

In a seller’s market, removing a home from the market takes it out of inventory, and it’s difficult to drum up enthusiasm for the home if it goes back. Especially in a seller’s market, it is much better for the seller to leave the home on the market in active status. However, a Sacramento real estate agent must present a true picture in advertising. This means we have to tell buyers that we have an offer. I accomplished that by adding a Pending Rescission modifier to the active status. In the confidential agent remarks, I suggested that agents write a back-up offer subject to the cancellation of the existing offer.

The sellers received a back-up offer, too. That’s because everybody wants something that somebody else wants. That’s a true principle that applies to real estate.

The sellers countered the buyers that they would leave the home on the market and remove it once the buyers had removed their contingencies. This way, everybody won, and the sellers felt more agreeable to accepting the offer.

How to Buy a Pending Home in Sacramento

buy a pending home in sacramentoSometimes, a Sacramento home buyer is in the right place at the right time. Or, better put, sometimes their Sacramento REALTOR is in the right place at the right time, and that means having her finger on the pulse of MLS. You’d be amazed at how few times during the day any given real estate agent gazes upon MLS, but that’s where one will find all of the action. Ya gotta cruise the news. If you think you can’t buy a pending home in Sacramento, think again.

Say, for example, that you are a Sacramento listing agent, and you’ve got a buyer who isn’t exactly cooperating. You might think: oh, who would do that in a seller’s market? A person like that would have to have a screw loose. But you would be surprised. Maybe it’s the buyer’s agent who has stopped responding to emails or phone calls. You might be astonished at how many agents struggle with communication issues or simply ignore attempts to reach them. There might be a contractual obligation that needs discussing such as putting an earnest money deposit into escrow, and maybe that hasn’t happened. That’s a warning sign a contract is about to be canceled and you might be able to buy a pending home in Sacramento. Or, maybe the buyer needs to release contingencies, and his 17 days has come and gone. Another warning sign. If you’re that listing agent, how would you get the word out to buyers that a listing might be coming back on the market soon?

Personally, I favor those big lights in the sky myself. Those honkin’ beams. Our days in Sacramento are getting shorter. Maybe with a bat insignia, like Batman. But I don’t have any of those. Can’t remotely run a scroll across the bottom of anybody’s iPhone like a CNN ticker tape. So the next thing that’s available is to do two things:

  • If the purchase offer was more than the list price, raise the price in MLS and
  • Slip “bring backups” next to the pending status in MLS.

It’s like going fishing. (Increased sales prices tend to gather more attention in MLS than a price decrease.) Minutes after that’s done, low and behold, this Sacramento REALTOR got a bite. I received an email from an inquiring buyer’s agent. She had shown a particular home in Sacramento to the buyer, and the buyer was very disappointed when it suddenly went into pending status, like they’re all doing right now. The buyer wrote an offer as a backup offer. Tip: To write a backup offer a seller can legally sign, one needs to submit a document that puts the offer into backup.

The seller signed the backup offer and issued a Notice to Perform to the buyer’s agent. The buyer failed to perform, so strings were cut and the new buyer slipped into place without this home ever going back on the market. So, if you are a Sacramento home buyer you might ask your buyer’s agent to glance over at MLS inventory several times during the day to see if there are any homes in pending status in which the seller wants a backup offer. This just might be your lucky day to buy a pending home in Sacramento.
